Terms and conditions
1. GENERAL INFORMATION
1.1. Through this platform, an initiative can only be created by natural persons (an individual or a group) who are of legal age, i.e., have reached 18 years of age and are citizens of the Republic of North Macedonia. By way of exception, an initiative can also be created by a civil society organization registered in the Republic of North Macedonia.
1.2. By submitting or supporting an initiative, you confirm that you are a person of legal age, i.e., you have reached 18 years of age.
1.3. Any person wishing to create an initiative on this platform must provide their personal data, such as first and last name and email address, or the name of the organization. The data you provide about yourself must be complete and true at the time you write it.
1.4. Any person creating an initiative must explicitly state whether they agree to have their name or the name of the organization displayed on the platform. If explicit consent is not given, those details will not be displayed.
1.5. Any person creating an initiative must declare whether they agree to receive notifications from CUP regarding the results of the campaign for the created initiative. If explicit consent is not given, CUP will not send notifications to the creator of the initiative.
1.6. CUP, as the owner and sole responsible entity for the "Iniciraj" platform, will use all submitted data in accordance with the Law on Personal Data Protection.
1.7. For the created initiatives, CUP conducts a public campaign on its social media profiles (Facebook, Instagram, LinkedIn) and before institutions, i.e., public official holders, when there is an opportunity.
1.8. The initiative will be submitted to the competent public institution, i.e., public official holder, if it meets the previously set threshold of supporters. CUP reserves the right to independently set the threshold for the number of supporters.
1.9. The initiative will remain published on this platform for a period of one year from its publication.
1.10. CUP disclaims all responsibility if the initiators obtain material or financial gain from the submitted initiative.
1.11. CUP bears no responsibility for activities in a campaign that is continued by another entity for an initiative originally launched through the CUP website.
2. INITIATIVE CONTENT
2.1. Submitted initiatives must not support any political party.
2.2. Initiatives should relate to societal issues, i.e., issues that affect citizens, and not issues that are of importance to a political party or individuals.
2.3. You are required to inform CUP if you are a holder of a public office so that this can be taken into account when processing the initiative.
2.4. The creator of the initiative must provide a justification of the problem and the proposed solution, which must be based on truths and facts.
2.5. If the creator of the initiative uploads audio-visual materials (photos, videos, etc.), by submitting the initiative they declare that these materials are their property, i.e., that third parties do not hold copyright over the images, text, and other content, or that you have permission or a license to use them in this manner.
2.6. By submitting the initiative, you grant consent for CUP to use, modify, reproduce, publish, and share the uploaded audio-visual materials for the purposes of the campaign for the submitted initiative.
2.7. CUP reserves the right not to publish an initiative if it:
- Violates human rights and freedoms.
- Disrupts the constitutional order of the state and encourages unlawful activity.
- Incites hatred, violence, and discrimination.
- Is contrary to the principle of democracy.
- Cannot be supported by independent evidence and data.
2.8. CUP reserves the right to remove any images, text, and other content that it considers inappropriate, offensive, calling for violence, or posing a threat.
3. LIABILITY
3.1. The "Iniciraj" platform is owned by CUP, which is solely responsible for its maintenance and the content published on it.
3.2. CUP carries no liability for any loss or gain, injury, or damage resulting from the publication of images, text, and other content submitted on the website in the context of proposed initiatives.
3.3. All visitors to the CUP website are invited to report content that encourages unlawful behavior, hatred, violence, discrimination on any grounds, or offensive and threatening content to info@cup.org.mk.
3.4. CUP reserves the right to change the terms of use of the site at any time, with the modified terms taking effect immediately upon publication on the CUP site. Users of the site bear sole responsibility for checking the terms of use.
3.5. Any downloading and republishing of content from the CUP website must be explicitly permitted in advance by CUP. All visitors to the CUP website are invited to report unauthorized downloaded and published content to info@cup.org.mk.
3.6. These terms of use are subject to the provisions of the legislation of the Republic of North Macedonia. In the event of a dispute arising from these terms of use, the dispute shall be resolved by the Basic Court Skopje 2 - Skopje.
