Great interest for the expert debate about the efficiency of the administrative and legal assistance and protection of the citizens

The Center for change management successfully realized the expert debate about the efficiency of the administrative and legal assistance and protection of the citizens.

On behalf of the Center for change management, the executive director of the organization, Neda Maleska – Sachmaroska, welcomed and greeted the attendees. The debate itself was moderated by Gordana Stefkovska – Veljanovska, project manager for the “Monitoring administrative justice” project, for which the research about the efficiency of the administrative and legal assistance was prepared.

Professor Dragan Gocevski presented his research about the work of the administrative courts and the second degree commissions in front of more then 60 professionals from the Administrative court and the commissions for the administrative and legal protection, the Ministry for information society and administration, the Ministries for justice and health, the health insurance fund, professors for administrative law, the IRS, the city of Skopje, the organization of consumers, the Macedonian young lawyers association as well as the lawyers who represent the citizens in administrative procedures and disputes.

On behalf of the MISA, the expert debate was also supported by the state secretary, Jahi Jahija, who spoke about the new practices established by the law on general administrative procedures from 2015.

The challenges in the work of the Administrative court were the main topic in the address of the President of this institution, Burim Sejdini.

He underlined the need for strengthening of the expert-administrative capacities of the Administrative court, through hiring of expert and professional administrative judicial employees and technical staff, through improving of the administrative building of the court, through changes and amendment of the legislative designed to secure the implementation of the decisions of the court. Mr. Sejdini also underlined the need for changes and supplementing of the legislative regarding the failure to submit the legal acts by the public institutions.  

The state counselor in the MISA, Biljana Nikolovska-Zhagar, spoke about the priorities of the regulation of the general administrative procedure, while the president of the state commission for decisions regarding the administrative procedure, Irena Brzanova, addressed the key factors for the efficient work of this institution.

The debate concerning the access to the administrative-legal assistance and its end result for the citizens also garnered great interest. The key note speakers in this debate were the people who deal with these issues on regular bases, such as the lawyers who take part in the administrative procedures and disputes: Zarko Hadji-Zafirov from the lawyer firm Bona-Fide and Fani Mihajlovska from the legal office - Mihajlovska. The consultant Jugoslav Gorgievski focused on the necessary changes in the work of the inspections

The last part of the debate was about the measures regarding the advancement of the efficiency of the administrative-legal assistance and practice. These measures were briefly introduced by professor Gocevski and afterwards they were analyzed from the aspect of their relevance, the possible difficulties in their implementation as well as the assessment of their end result, by three different working groups.
