Free access to the Official Gazette

Problem description

According to the Constitution, laws and other regulations must be published in the *Official Gazette* before entering into force. Laws and other regulations generally enter into force no earlier than the eighth day following their publication; however, as an exception determined by the Assembly, they may enter into force on the day of publication. The purpose of publication is to enable citizens to familiarize themselves with the content of laws and regulations governing their rights and obligations, and consequently to adjust their conduct accordingly. Yet, to access the *Official Gazette*, citizens are required to pay a subscription fee of: 7,000 denars (annually) for electronic editions, or 1,650 denars (monthly) / 16,650 denars (annually) for electronic editions. This subscription requirement hinders citizens' access to laws and other regulations—a constitutional right—thereby undermining the rule of law. Proposed solution

Enabling free access to the electronic editions of the "Official Gazette." Specifically, amending the Law on the Publication of Laws and Other Regulations and Acts in the "Official Gazette" with the aim of: - Abolishing the mandatory printed edition of the "Official Gazette," with printed editions to be issued only upon a party's prior request. - Making access to the electronic editions of the "Official Gazette" free of charge for all citizens.
